[case update] Marijuana charges dismissed after judge excludes use of evidence

BISBEE - In response to a motion from deputy county attorney Roger Contreras, Cochise County Superior Court judge Wallace Hoggatt ordered the dismissal of all charges pending against Michael Wayne Bennett.
Hoggatt’s order was filed January 6, nearly two months after the judge ruled deputies entered Bennett’s rural Sierra Vista home “in violation of the Fourth Amendment" on April 18, 2014. That decision led Hoggatt to suppress all the evidence seized that day by deputies and to suppress any statements Bennett made at the time of the search and his arrest.
